Welcome to YardAndPlant.com. Before you create an account you must read and agree to these terms and conditions. By creating an account, you agree to these terms and conditions. These terms and conditions apply to all visits to the site, both now and in the future. YardAndPlant.com reserves the right to change these terms and conditions from time to time at its sole discretion.

Web Community Services

The Discussion Forum is the part of the website where YardAndPlant.com members exchange information, questions and comments with each other regarding anything related to plants, gardening, and landscaping.

The Plant Wiki is the part of the website where YardAndPlant.com members can add and edit a common encyclopedia of information regarding plants, gardening, and landscaping.

The Photo Database is the part of the website where YardAndPlant.com members can upload pictures related to plants, gardening, and landscaping and tag those photos (and also the photos of others) with various search tags.

Each of these community services are an AS IS and AS AVAILABLE basis. YardAndPlant.com reserves the right to modify, suspend or terminate any of these services and/or your use or access to these services with or without notice. YardAndPlant.com will not be liable to you or any third-party for any modification, suspension, or termination of these services, or termination of your access to these services.

Anyone can access and read any of the information in any of these services. You must register with YardAndPlant.com to be able to contribute to any of these services.

Registration

You must be at least eighteen (18) years old to register with YardAndPlant.com. You must provide current, accurate, and complete information about yourself that may be required as part of the account creation process and/or continued use and participation. You are responsible for maintaining the confidentiality of your password and account, and are entirely responsible for any and all activities that occur under your account. YardAndPlant.com reserves the right to refuse access to any of the community features of the site to anyone at any time without notice for any reason.

Specific Guidelines for Use

Participants must not engage in any illegal conduct in the YardAndPlant.com web community services. In particular, you cannot post, publish, or distribute any defamatory, obscene, infringing or other unlawful material or information in the web community services.

Please treat others in the YardAndPlant.com web community services as you would expect them to treat you. Personal attacks or any type of "flaming" of other community members will not be tolerated. Participants who "talk trash" about another user may be banned from participating. Please also refrain from "trolling", i.e. posting topics or opinions that are designed to provoke a negative response from one or more specific users.

Keep offensive language to a minimum. If you have any doubts about whether a particular statement might be considered offensive by other users, please do not post it. You do not need to use profanity to get your point across to other users.

Do not engage in disruptive activity in the YardAndPlant.com web community services, such as persistent off-topic postings or comments, or statements that might incite other users to violate these guidelines or participate in illegal activities.

Do not post messages or upload files that contain photos, software or other material protected by intellectual property laws, rights of privacy or publicity, or any other applicable law unless you own or have rights to these materials. Most images posted on the web are the intellectual property of someone else and cannot be used without permission. In general, restrict photo uploads to photos you take yourself.

Do not post any instructions, software or other materials that would allow community users or third parties to harm other users' computers or to inappropriately access software or websites.

You are not permitted to post any computer programs that contain destructive features, such as viruses, worms or Trojan horses. In addition, you cannot employ any type of bots for the use of scrolling, showing multiple screens, or other activities that might disrupt online communication.

You may not falsely impersonate any other person in the community, including YardAndPlant.com owners, employees, or agents.

Please do not use the YardAndPlant.com web community services to spam other users, including sending identical and irrelevant submissions to many different discussion groups, mailing lists or communities. Such postings will rarely be of interest to any YardAndPlant.com participants. You also may not misrepresent the source of anything you say or post.

While you may use the YardAndPlant.com web community services to provide supplemental information about your own business that might be of interest to other users, your postings should not primarily be about promoting yourself or your business. Such posts will be removed.

Any space provided to you in any YardAndPlant.com web community services is for your own personal use, and may not be sold, licensed, exchanged or bartered for any purpose, including advertisements.

You are responsible and liable for all your activities while participating in the YardAndPlant.com Discussion Forum, including anything you say or post.

Do not rely on the YardAndPlant.com web community services for the safe and secure storage of any materials, such as photos, documents and software. YardAndPlant.com is not responsible for the alteration, deletion or loss of any stored items. We strongly recommend that you maintain back-ups for any materials that you post.

YardAndPlant.com reserves the right to remove at any time, without notice, any message or posting that violates these guidelines. YardAndPlant.com also reserves the right at any time, without notice, to ban a user who has violated these guidelines from any or all YardAndPlant.com web community services.

Some participants may post Internet website links in their area. YardAndPlant.com is not responsible for the content on the websites associated with these links. In addition, we must remind you that some content and links on the Internet contain adult content that is not suitable for children and may be offensive to some users. We encourage parents to join their children as they surf and explore the Internet.

You are responsible for any actions you may take based on information or advice you receive while online. Please use your own good judgment when evaluating information provided through the YardAndPlant.com web community services or any other communication service. The decision to share information or conduct transactions with anyone is your own - please conduct your own research prior to making any decisions.

YardAndPlant.com does not claim ownership of any content or materials you post, upload, submit or otherwise provide to YardAndPlant.com and assumes no responsibility of any kind with respect to such materials. All such content or materials are deemed be provided on a non-confidential basis and by providing such content, you grant YardAndPlant.com and all other users of the web community services an irrevocable, worldwide, royalty-free, nonexclusive license to use, reproduce, modify, distribute, transmit, publicly display, publicly perform, adapt and publish such content or materials. You represent and warrant that you either own or have the necessary rights in the contents or materials placed in the Forum, to grant YardAndPlant.com and other users of the Forum the rights and licenses contained herein. YardAndPlant.com is not responsible for the use of anything you say or post in its web community services.

Indemnification

If YardAndPlant.com and its subsidiaries, affiliates, directors, officers, agents, and employees should incur any liability to a third party arising out of or in any way related to your use of the Forum, you agree to indemnify and hold YardAndPlant.com free and harmless from any such liability, and from all loss, claims, costs, demands, debts and causes of action in connection therewith, including reasonable attorneys' fees.
